Terms of service.

Effective Date: April 27, 2026

 These Terms of Service ("Terms") form a legal agreement between you and MoonBow Labs LLC ("Minis," "we," "us," or "our") and govern your access to and use of the Minis  mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement.  

  The Service is intended for parents and guardians who want to keep a private timeline of moments featuring children in their care. You confirm that any child whose photos or videos you upload is your child or that you have the necessary parental or legal authority to upload that content.

2. Your Account

  You are responsible for the accuracy of the information you provide when creating an account, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization.

  You may sign in using an email address and password or with Sign in with Apple. We reserve the right to refuse, suspend, or close any account that we reasonably believe  was created under false pretenses or in violation of these Terms.

3. Subscriptions

  Minis offers auto-renewable subscriptions that unlock premium features. If you choose to subscribe:                                                                      

  - Title and length: subscriptions are offered as monthly and annual plans. The current options and any free trial are presented to you at the point of purchase.         

  - Price: pricing is shown at the point of purchase and may vary by region and over time.

  - Payment: payment will be charged to your Apple ID account at confirmation of purchase.                                                                                 

  - Auto-renewal: your subscription automatically renews at the same plan and price unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.                                                                              

  - Managing your subscription: you can manage or cancel your subscription at any time from your Apple ID account settings (iOS: Settings → [your name] → Subscriptions). Deleting the Minis app does not cancel your subscription.                                                                                                                

  - Refunds: refund requests for App Store subscriptions are handled by Apple. You can request a refund at https://reportaproblem.apple.com.

  - Free trials: if your subscription includes a free trial, the trial converts to a paid subscription at the end of the trial period unless you cancel before the trial ends. Any unused portion of a free trial is forfeited when you start a paid subscription.                                                                                

In all cases, we will display the applicable terms (length, price, renewal frequency) before you complete a purchase. By completing the purchase, you accept those terms.

4. Other Payments

  Outside of App Store subscriptions, payments to us are non-refundable except where required by law or as expressly stated at the time of purchase. We may change prices  for new or renewed purchases at any time; any change will be communicated before it takes effect.

5. Your Content

You retain all ownership of the photos, videos, names, and other content you upload to the Service ("Your Content"). To operate the Service for you, you grant MoonBow   

  Labs LLC a worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce, modify (e.g. resize, transcode, generate thumbnails and slideshow videos and display Your Content solely for the purpose of providing and improving the Service to you and the family members you've invited. This license terminates when you delete the relevant content or delete your account, except for backups retained for the periods described in our Privacy Policy.

  You are responsible for Your Content. You represent and warrant that you have all rights necessary to upload it and that it does not infringe anyone else's rights or violate any law.

6. Family and Collaboration

  You may invite other people to view or contribute to a timeline you own. By doing so:      

  - You authorize us to send an invitation email to the address you provided.                                                                                              

  - You acknowledge that any content the invited person can see will be visible to them across their devices for as long as their access remains active.

  - You may revoke a family member's access at any time from the app's collaboration settings.                                                                             

  If you accept an invitation to someone else's timeline, you agree that the timeline owner controls the content on that timeline and you may lose access at any time at their direction.                                                                                                                                                         

7. Acceptable Use

You agree not to:

  - Use the Service for any unlawful purpose or to violate anyone's rights.                                                                                                

  - Upload content that is obscene, sexually explicit, abusive, harassing, defamatory, or that depicts a child in a sexualized manner.

  - Upload content that infringes intellectual property rights or violates a person's privacy.                                                                             

  - Attempt to access accounts, content, or systems that don't belong to you.

  - Reverse engineer, decompile, or attempt to extract source code from the Service, except as permitted by applicable law.                                                

  - Use the Service to send spam, malware, or harmful code.                                                                                                                

  - Use automated means to access or scrape the Service.                                                                                                                   

We may remove content and suspend or terminate accounts that we reasonably believe violate these rules.                                                                  

8. Our Intellectual Property

The Minis name, logo, app, and Service (excluding Your Content) are owned by MoonBow Labs LLC and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for personal, non-commercial use, and subject to these Terms. No other rights are granted.                                                                                                                                      

9.Termination

You can stop using the Service at any time. To delete your account and all associated data, use Settings → Delete account in the app. Deletion is described in more detail in our Privacy Policy.

We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, if continuing to provide the Service to you creates a security or liability risk, or if we discontinue the Service. Where reasonable, we will give notice before doing so.

Sections that by their nature should survive termination — including ownership, license to Your Content (with respect to content you don't delete), disclaimers, limitation of liability, indemnification, and governing law — will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES  OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES.

Face recognition is not guaranteed to identify every photo of your child or to exclude every photo of someone else. The Service is intended for personal memory-keeping, not for identification, surveillance, or any safety-critical use.

We do not guarantee that uploaded content will be retained indefinitely. We strongly recommend keeping your own backups of any photos or videos that matter to you.      

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONBOW LABS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE.

                                                                                                                                                                    OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS.

                                                                                                                                                                    Some jurisdictions don't allow certain limitations on warranties or liability, so some of the above may not apply to you.                                                

12. Indemnification

You agree to indemnify and hold MoonBow Labs LLC and its officers, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.                                                                                                                                                       

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in San Francisco County, California, and you consent to that jurisdiction.                                                                                                                                                            

If you are a consumer in a jurisdiction whose law gives you the right to bring proceedings in your local courts, nothing in this section limits that right.              

14. Changes to These Terms

  We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before the changes take effect. The "Effective Date" at the top of this page reflects the most recent update. Your continued use of the Service after the Effective Date means you accept the updated Terms.

15. Apple-Specific Terms

  You and we acknowledge that these Terms are between you and MoonBow Labs LLC only, and not with Apple Inc., and that Apple is not responsible for the Service or its content. Apple has no obligation whatsoever to provide maintenance or support for the Service.

  In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the applicable purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service.

  You and we acknowledge that we, not Apple, are responsible for addressing any claims relating to the Service, including (a) product liability claims, (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection or similar legislation.

  If a third party claims that the Service or your use of the Service infringes that party's intellectual property rights, MoonBow Labs LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

  You represent and warrant that (i) you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.

  You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Miscellaneous

  These Terms, together with the Privacy Policy, are the entire agreement between you and MoonBow Labs LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
